Contract
(Party A) wishes to engage the services of (Party B, from ) as an English teacher. The two parties, in a spirit of friendly cooperation, agree as follows,
Ⅰ. The schedule and location of the Teaching Services
A. Teaching services will be fixed from , to July 25th, 2009 , at our University.
B. Living and working arrangements will be the responsibility of Party A.
C. Party B will be required to teach teaching periods ( hours) per week. “Extra” teaching hours will be calculated at Yuan RMB per hour, based on the monthly average of hours taught.
Ⅱ. Requirements to Party B
A. Part B will conform to Party A’s teaching requirements and scheduling for language classes to postgraduates and special program students.
B. Party B will observe the laws, decrees, and relevant regulations of the Chinese government, concerning foreigners; and all of the regulations of Party A, including regulations for teaching, accommodations, and lodging.
C. Party B will receive Party A's professional arrangements along with instructions; and will carry out all assigned curriculums.
D. It will be considered a breach of contract for Party B to solicit, engage or direct in any other assignments of teaching or conduct any other business activities without the written authorization of Party A.
E. Acts of being Ethically Unprofessional and Physical/Sexual contact with the students, by Party B, will be considered intolerable and will result in immediate termination of the Foreign Experts position.
F. Both parties will at all time maintain a cooperative educational environment, based on understanding and professionalism.
Ⅲ. Salary and lodging
A. For each working month, Party A shall pay Party B a monthly salary of_ 5000-7000 Yuan RMB based on 20-24 teaching Hours per week; 30% of the salary can be converted into foreign exchange. The salary will be paid between the 25th to the 30th of the month.
B. During winter vacation, Party B will only be paid 3000 Yuan RMB instead of his/her regular monthly salary.
C. Additionally, an allowance of 1100 Yuan RMB will be paid for both winter vacation and summer vacation, based on the service of two semesters.
D. Party A will pay Party B a total of 7500 RMB for international airfares provided that teaching services are rendered for two semesters. This will be paid in July only.
E. Round trip train tickets totaling 600 Yuan RMB will be reimbursed in two payments.
F. Party A will provide Party B with free housing, necessary equipment, and suitable living and working conditions for each foreign teacher.
Ⅳ. Medical Care
A. All foreign teachers should annually go to relevant hospitals, appointed by Party A, to take physical examinations at the beginning of their service. The expenses of the examinations will be provided by Party A.
B. It is recommended that foreign teachers return to their own countries for major health problems.
C. Party B must purchase international medical insurance by himself/herself in his/her own country.
D. Party A will pay 50 Yuan RMB monthly to Party B for medical care expenses. Party A will be exempt from any medical obligations or payments whereas illness may occur to Party B.
Others
A. The water, power, gas and telephone bill altogether for each foreign teacher is approximately 400 Yuan per month. Party A will cover this monthly 400 Yuan RMB expense. However, the monthly telephone bill of each foreign teacher is kindly requested to be lower than 100 Yuan RMB; otherwise, the over part will be provided by Party B. One extra family member, an extra 50 Yuan RMB payment per month for telephone service.
B. Party A will provide Party B with the internet access and a desktop system in each newly furnished apartment. The internet service charge, which is 85 Yuan RMB per month, will be paid by Party B monthly.
C. Should family members visit or accompany Party B; Party B must assume all responsibilities for all related matters pertaining to his/her family members, including all expenses, medical care, educational tuitions, etc..
D. Party B will pay a monthly 100 Yuan RMB for the extra use of furniture and house maintenance if Party B 's accompanying family members are not employed teachers of Party A. Party A will deduct this from Party B’s salary monthly.
E. If Party B is absent, ` in one semester, altogether for a period greater than a total of 6 hours, Party A will deduct from Party B's salary the amount of 80 Yuan RMB for each hour absent. Should Party B make up the absent hours, the deducted money will be reimbursed to Party B. Party B should submit to Party A a detailed schedule for the make-up classes in advance.
F. Party B should keep the furniture, appliances and facilities in the apartment in a condition acceptable to Party A. Party A will inspect the apartment’s condition regularly and especially at the end of the contract period. In case of any damage, Party B will be responsible for the cost of repairing or replacing any damaged furniture, appliances and facilities.
G. For good, we hereby suggest you get in touch with strangers and make friends with great discretion. Without Party A’s authorization, you are kindly requested not to live off campus or provide your accommodations for any people other than your own family members in any case.
H. Before Party B leaves the university, Party B needs to clean the apartment and facilities properly, and have the Permit of Departure signed by the relevant departments.
