CONTRACT
I、Party A wishes to engage the service of Party B Mr as the English teacher. The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.
II、The period of service will be from the of Feb , 2012 to
the 20th of Jan , 2013 .
III、Party B’s monthly salary will be Yuan RMB. When Party B teaches for less than one month, then the amount paid to Party B for Party B’s service shall be calculated on the number of actual teaching days and prorated accordingly. The daily payment shall be calculated as 1/30of the monthly salary.
IV、The paying day is 10th of every month for the previous month. The June and January salary will be paid on the first salary date after the holiday.
V、Party A’s Obligations:
1、Party A shall introduce to Party B the laws, Decrees and relevant regulations enacted by the Chinese government, the Party A’s work system and regulations concerning administration of foreign experts.
2、Party A shall conduct direction, supervision and evaluation of Party B’s work .
3、Party A must pay Party B’s salary regularly on due date.
4、Party A will provide free lodging to Party B .Apartment (a bed-room for single use and a bathroom, a sitting-room and a kitchen , facilities including a washing machine, refrigerator, computer with Internet access, and so on)
VI、Party B’s Obligations:
1、Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and must not interfere in China’s internal affairs.
2、Party B shall observe the regulatons concerning administration of foreign experts and Party A’s work system and shall accept Party A’s arrangement, direction, supervision and evaluation in regard to Party B’s work(see attached appendix). Without Party A’s consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.
3、Party B shall respect administration personnels and assistants and obey the school’s arrangement, complete the tasks agreed on schedule and guarantee the quality of work.
4、Party B shall respect China’s religious policy, and shall not conduct religious activities incompatible with the status of an expert.
5、Party B shall respect the Chinese people’s moral standards and customs.
6、The cost for water, power , telephone and so on is to be borne by Party B.
7、Party B shall protect the furniture and facilities. Party B shall pay for fixing or repairing if it is destroyed. Party B shall guarantee all the facilites and well used when the contract ends.
8、If Party B requests sick leave, a doctor’s illness report must be provided . During sick leave period Party A doesn’t pay Party B salary.
9、Party B’s compassionate leave must get Party A’s permission and Party A won’t pay Party B the salary during the compassionate leave period. During the working period, Party B’s compassionate leave should not exceed 3 day per month. If Party B is absent from the work for one day without Party A’s permission, Party A will deduct three days salary from Party B .If Party B misses one class without Party A’s permission, Party A will deduct 100yuan salary from Party B.
VII、Revision, Cancellation and Termination of the Contract
1、Both Parties should abide by this contract and should refrain from revising, canceling, or terminating the contract without mutual consent .
2、If party B can not shoulder the teaching task, either no teaching experience or not welcomed by teachers, students or the school, Party A has the right to cancel the contract.
3、The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.
4、Party A has the right to cancel the contract with a written notice to Party B under any of the following conditions:
⑴、Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated and failed to amend after Party A has pointed it out.
⑵、Party B does not ask for leave in written and doesn’t go to work for three days or more without the school’s permission.
⑶、According to the doctor’s diagnosis, Party B cannot resume normal work after a continued 10 day sick leave.
(4)、Party B does not abide by the laws or regulations, so Party B can’t go on working.
(5)、If Party B is given warning three times.
5、Party B has the right to cancel the contract with a written notice to Party A under the following conditions:
⑴、Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.
⑵、Party A has not paid Party B as scheduled.
VIII、Breach Penalty
When either of the two parties fails to fulfil the contract or fails to fulfil the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US $500(or the equivalent in RMB4000)
IX、This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 60 days prior to the expiration of the contract, and sign the new contract with mutual consent.
Party B shall bear all expenses incurred when staying on after the contract expires.
X、Arbitration
The two parties shall consult with each other and mediate any disputes, which may arise about the contract. If all attempts fail, the two parties can appeal to organization of arbitration and asks for a final arbitration.
This contract is signed at Yuncheng , in duplicate, the of , 2012 , in the Chinese and English languages, both texts being equally authentic.
Ⅺ、The appendix belongs to the contract. It has the same effect with the contract.

Appendix
1. Workload: with 20 class hours per week, and one students’ activity or one teaching exchange communication every week.
2. Holidays: winter, summer holiday, according to the school’s schedule.no salary on winter and summer vacation.
3. If weekly class is more than 20 hours, any extra class is 50 yuan.
4 Party B should have teaching plan for every lesson and a summary in written at the end of the term.
5. Party B should be punctual to class, should not be late for class, exit earlier, or be absent without reasons.
6.Party B shall obey Chinese Educational System, no entering school with shorts,vest or slippers, no smoking or spitting in school yard or class and accept the adjustment of schedule because of exams or holidays(including Saturday and Sunday) ,Or if Party B misses one class without Party A’s permission, Party A will deduct 100yuan salary from Party B.
7. Party B should attend the meetings and activities that hold by the school.
The school will give a warning in written and doesn’t pay the salary of that day if party B doesn’t attend the meeting or an activities without permission.
8. To ensure the health and safety, the foreign teachers in the apartment maynot have pets
9. In the course of the contract, if Party B has to leave for some reason, application should be provided to Party A 30 days in advance. If leaving without reason,Party A shall report it to the State Administration of Foreign Expert Affairs and Exit & Entry Administration Department of the Ministry of Public Security,Cancel the Viza and publish online, as well as have Party B take the economic responsibility.
10. Holidays: Winter holiday, according to the school’s schedule, no salary on Winter holiday. Party A will pay Party B 1000 Yuan RMB as subsidy for traveling in Winter vacation.It will be paid on the first salary date after the vacation.
11. Party A will pay Party B 7000 RMB as the air ticket subsidy after the one year contract ends.
