1、Work assignment
1.1 Party B shall accept Party A’s work assignment which is 20 lesson periods as well as 4 periods of activities every week. If Party A needs and Party B is willing to accept more periods, Party A shall pay Party B 80RMB/period in accordance with Party B’s extra work after the discussion between them. Party A will check and pay for the extra periods at the end of each month. If Party B’s weekly periods do not come up to the mentioned periods, he/she shall obey the school’s arrangement which could be to teach classes within the Department, Domestic School and to prepare teaching plans.
1.2 Party B shall strictly carry out syllabus, and work out the teaching aims and plans according to the students’ levels. Party B must hand in weekly teaching plans to the Education Administration Department at 8:00 on each Monday morning. Party B shall prepare for the lessons adequately, employ teaching methods that are flexible and provide the necessary accessorial teaching materials based on actual circumstances.
1.3 The text books and other teaching materials used in class shall be agreed upon by Party A. Movies, video tapes etc. provided by Party B for teaching can only be used with Party A’s permission. Party B shall not teach any content or conduct any activities irrelevant to his/her teaching.
1.4 Party B should be strict with the students and prepare for all the subjects adequately, be able to understand a student’s ability, respond to a students as needed, assign and correct the students’ homework accurately, try to coach the students and answer questions in spare time, direct and join in the English corner as required, report the students’ study situation to the leader of English teaching and research section regularly.
1.5 Party B should make a good preparation for the end-of-term review and examination, and give remarks to the students strictly and accurately according to the examination rules of the school. The remarks should be correct and objective.
1.6 Party B should attend the activities organized by the teaching and research section, cooperate with Chinese teachers, who in turn shall cooperate with them and discuss teaching affairs in order to improve the teaching quality.
1.7 Party B should abide by the teaching and living rules of the school and obey the school regulations. Party B shall arrive and leave the school according to the school’s stipulation. A deduction will be made for Party B’s absence (monthly salary/monthly periods=salary/period), and a fine of 50 RMB will be imposed for being late or leaving class early without Party A’s permission.
1.8 During the teaching term, Party B should not change his/her lessons at will or be absent for due to travel. If there is a need to change lessons, Party B must write out an application and hand it to the Education Administration Department to clarify the reasons and ask for permission. If Party B should attend the foreign affairs activities, the school will arrange for the change of lessons. Without Party A’s permission, Party B agrees not to undertake any private tutoring positions.If it happens,Party A will immediate the contract.
1.9 Party B shall accept teaching inspections in either visiting classes or any other forms.
1.10 If Party B has any problems of teaching, turn to the Education Administration Department directly. Teaching questions will be settled by Principal’s Office and Education Administration Department through coordination.
2、The salary treatment
2.1 Direct payment
Monetary salary _ _ RMB/ month. The salary is paid by RMB and the salary is paid monthly. The time is at the end of the month. In case the time is shorter than a whole month, the payment shall be counted by day. The daily wage shall be 1/30 of the monthly salary.(applicable to February). Party B shall pay the personal income tax in accordance with the Personal Income Tax Law of People’s Republic of China. 2.2 Indirect Payment
(1) Provide free Internet facilities in the office.
(2) Party B shall pay for meals of his or her own. However, for lunches during working days, Party B has the same rights as the Chinese teaching staffs.
(3) Party A will guarantee the fundamental living conditions for the Party B in China. Party A shall provide Party B with free housing equipped with furniture, a TV set, a micro-wave oven, a refrigerator, a washing machine, an air-conditioner, a water dispenser, a water heater (Gas will be provided by Party A but the cost of gas shall be borne by Party B) . If Party B requires more electrical appliances, or to install telephone or Internet. Party B shall ask Party A for permission and the cost of purchase and installation will be born by Party B. When Party B is leaving China, upon the expiration of the contract, Party A shall inspect the housing. If there is any damage, Party A shall ask Party B to pay for the loss according to the degree of damage.
(4) On completion of the contract Party A shall reimburse Party B 1,000 RMB for a one year contract and 500 RMB for one half year contract based on the hospital receipts. Expenses for registration, tooth inlaying, dental cleaning, face lifting, massage, glasses, meals in hospital, tonics not for medical purpose, and doctor’s house calls shall be covered by the Party B.
(5) Party A shall pay Party B 500RMB/term for a half year contract and 1000RMB/year for travels organized by Party A.
(6) Party A will pay for a round-trip air ticket after finishing a one-year contract. Party A will pay for a one-way air ticket if Party B finishes a half-a-year contract. The air ticket shall be the economical one that is from Shanghai, China to the nearest city in Party B’s country. The money will be paid in cash when the contract ends and Party B needs to show the receipt of ticket. If Party B does not go to the hometown during the contract period, Party B will still be paid a sum of money by Party A as a compensation for the air ticket according to the 80% of quote Shanghai International airport provides at that time, when the contract ends.
3、Work Time, rest and holidays
3.1 The work time of Party B shall be 5 days (from 7:40 am-4:10 pm; from Monday to Friday) every week. Party B shall have lunchtime from 11:50 to 12:40.
3.2 If Party A arranges overtime work for the Party B, it will pay Party B 80RMB/period.
3.3 Party B is entitled to have the same holidays as Chinese teachers in the school.
3.4 Party B under over-one-year contract is entitled to be paid a 20-day-long winter vacation. If Party B wants to go traveling on vacation, he/she has to inform Party A in advance. And Party B shall be responsible for expenses and his/her own security.
4、Sick leave and private affairs leave
4.1 Certificates from doctors for foreigners appointed by Party A should be presented when the Party B asks for sick leave. If the sick leaves amount to less than half-a-day in one month, no salary will be deducted. If the sick leaves amount to over half-a-day in one month, a deduction by day will be made for Party B’s sick leaves. If the sick leaves amount to more than 30 days within one contract term, Party A has the right to terminate the contract.
4.2 Private affairs leave of Party B shall be approved by Party A. Party A will deduct the salary by day. In the contract term, the accumulative private affairs leaves should not exceed 10 days and continuous private affairs leave should not exceed 3 days. Two days’ salary will be deducted for each day thereafter. In case of absence from work without Party A’s permission, 3 days’ salary will be deducted for each absence day. For serious circumstances, Party A has the right to terminate the contract and investigate the liability of Party B for violation of the contract.
4.3 Party B should make up the missing classes after private affairs leave. If the school arranges other teachers to substitute, the teachers who substitute for the absent teacher will get 80 RMB/period from the school.
5、Party B cannot accommodate a guest for the night without permission of Party A. Party B has to inform the school in advance if Party B will leave the local city during the weekends or holiday. Party B cannot indulge in excessive drinking. Party B cannot raise pets on campus.
6、The probation period of the Contract and Reputation Deposit
6.The probation period of Party B shall be 30 days. During this time Party B will assume the costs for the Visa, and medical check up. After the Probation period, Party A will reimburse Party B for the expenses should Party B pass the Probationary period without incident. During the probation period, if Party A finds out that Party B is unfit for the assignment specified in the contract for reasons of health (by doctor’s diagnosis) or professional ability, Party A has the right to terminate the contract.
7、The terms and conditions of this Contract are strictly confidential. Without Party A’s permission Party B is not allowed to disclose the terms and conditions of this Contract to any third Party. Should this happen Party A is entitled to terminate this Contract and the breaching Party shall bear the responsibilities according to actual situations.
8、Confirmation and change of every term of the appendix of the standard contract must be stipulated in written form through negotiation between the two parties. Any oral agreement will be regarded as invalid. This appendix has equal validity of the standard contract and comprises an integral part of the contract.
